In Brief
Eleven persons were tried for the murder of two victims on 12.02.1997. The trial court acquitted one accused; the High Court acquitted two more. Of the remaining eight, only two appellants reached the Supreme Court. The Court found that these appellants were not named in the two FIRs filed immediately after the crime but were named only ten days later. Finding this delay and absence from contemporaneous FIRs created reasonable doubt about their involvement, the Supreme Court acquitted them and set aside their conviction and sentence.
