Yogendra Pal Singh vs Raghvendra Singh alias Prince and Anr

Bench: 2 — B.V. Nagarathna, R. Mahadevan

In Brief

A young woman died within four months of her marriage from poisoning, amid credible allegations of dowry demands and sustained cruelty by her husband. The Supreme Court set aside the High Court's grant of bail to the accused husband, holding that once foundational facts triggering the statutory presumption under Section 113B of the Indian Evidence Act are prima facie established, bail cannot be granted lightly in dowry-death cases. The Court emphasised that such crimes strike at the collective conscience of society and warrant strict judicial scrutiny to protect women's dignity and deter perpetrators. The Court annulled the bail order and directed the accused to surrender immediately.
