YOGESH GOYANKA vs GOVIND & ORS

Bench: 2 — Vikram Nath, Satish Chandra Sharma

In Brief

A man purchased farmland through a registered deed during a pending lawsuit over the same property. The seller knew about the lawsuit before selling. The buyer later asked to be added as a defendant to protect his interests. The court had rejected his request, relying on a doctrine that treats wartime sales as void. The Supreme Court allowed his appeal, holding that pending litigation doesn't automatically void a sale. Instead, it makes the buyer's rights subject to the court's directions. The buyer can be added to the lawsuit if circumstances suggest possible collusion between the original parties, such as family relations and unexplained delays.
