“You will make us take some tough decisions” says the Supreme Court while hearing transfer of the judge’s issue

Today, the Supreme Court bench including Justices Abhay S Oka and Sanjay Kishan Kaul asked Attorney General N Venkataramani when they will notify the proposal of the Collegium, issued in December, to elevate five judges to the Supreme Court. The top Court also questioned the Central government’s delay in processing the judicial appointments. To this, the AG replied that the proposal will be notified soon and asked them to give some more time for the same. The bench further stated that “Okay, ten days. I am taking your word for the five judges, the transfers, and the High Court Chief Justice. On this, I am giving you ten days.”
Collegium recommended the name of five judges for the appointment as Supreme Court judges on December 13, 2022, including, Justice Manoj Misra, Justice Pankaj Mithal, Justice P.V. Sanjay Kumar, Justice Sanjay Karol, and Justice Ahsanuddin Amanullah.

While hearing the case, the bench also addressed the issue of the transfer of judges, “let’s come to the rest..If transfer orders are not implemented, what do you want us to? Should we withdraw work from them? If we think somebody should be working in B court instead of A court… This is very very serious to my mind. You will make us take some tough decisions. I understand you have something to say about new appointments. But transfers? It’s a serious issue.”
In addition, the top Court also heard the issue of the Centre not appointing names listed by the Collegium long ago which was presented by Advocate Prashant Bhushan. The Apex Court stated that they will hear the matter on February 13, 2023.
