Today, the matter (Google vs CCI) was resumed by the three-judge bench including Chief Justice of India DY Chandrachud, Justice JB Pardiwala, and Justice PS Narasimha. CJI asked ASG Venkataraman (representing CCI), to send it back to NCLAT. CJI DY Chandrachud also highlighted that “We will say matter will be listed in NCLAT on Monday. There will be no adjournment and protection from coercive action for two weeks. We will merely set aside this order and ask NCLAT to look into it on Monday. We won’t even pass an interim order.” While hearing this, representatives of both parties, ASG Venkataraman (CCI) and Dr. AM Singhvi (Google) wished the matter to be heard by the Supreme Court only.

CJI further stated that “Since it is 3:45 already, we’ll hear it tomorrow morning, we’ll hear on merits of stay. We will take it up at 11:30 or when all of you are here, whichever is earlier.” Moreover, regarding the question raised in the last hearing, Whether Google will implement the same European Union approach in India, the bench was told that Google is not willing to follow the same approach as of European Union.
