A. Selvaraj vs C.B. M. College and Ors

Bench: 2 — M.R. Shah

In Brief

A retired Associate Professor of an aided college was not paid his retirement benefits on time despite multiple representations. While the High Court acknowledged he was entitled to interest on the delayed payment, it deferred the decision pending a government enquiry into who was responsible. The Supreme Court held that regardless of inter se disputes between the college, government, and officials about blame, the employee cannot be made to suffer. It quashed the High Court's order and directed the college to pay interest immediately (within six weeks), with the right to recover from whoever is ultimately found responsible for the delay.
