A newly established medical college challenged the Ministry's decision to debar it from admitting students for two years and encash its ₹2 crore bank guarantee due to deficiencies. The Supreme Court partly allowed the petition, directing that students already admitted under conditional permission continue their studies. The Court ordered the MCI to conduct fresh inspection within three months and give the college time to remedy deficiencies. Importantly, the bank guarantee cannot be encashed until the Ministry takes a final decision, and if already encashed, it must be refunded. The Ministry must complete its final determination within one month of the MCI's recommendation while maintaining procedural fairness.
