Glocal Medical College and 18 other medical colleges challenged the Central Government's order dated 31 May 2017, which cancelled their conditional permission to establish MBBS programmes and debarred them from admitting students for two years. The Supreme Court held that the decision was unsustainable as it failed to address the Oversight Committee's recommendation for confirmation of the conditional permissions. The Court found that the decision violated the requirement of reasonable opportunity of hearing mandated by Section 10A(4) of the Indian Medical Council Act. The Court remanded the matter, ordering the Central Government to reconsider all materials afresh, specifically evaluating the recommendations of the MCI, Hearing Committee, DGHS, and Oversight Committee, within ten days."
