A medical college challenged the Ministry's decision to reject its establishment application despite an Oversight Committee's conditional approval. The college claimed it had admitted students for 2016-17 and sought admission for 2017-18. The Supreme Court rejected the relief for fresh admissions but held that students already admitted must be allowed to continue. It directed the MCI to reassess the college within three months and give it time to cure deficiencies. The Ministry must then decide within one month using a constituted hearing committee. Critically, the Court froze the Rs. 2 Crore bank guarantee, prohibiting encashment until final determination.
