This appeal challenged the quantum of sentence awarded to the appellant for attempted murder under Section 307 IPC. The appellant, armed with a country-made pistol and acting with two others in common intention, fired at and grievously injured a man in the head. The injured person survived, and the appellant argued that since death did not result, he should receive only ten years' imprisonment instead of life. The Supreme Court upheld the life sentence, holding that the grievous nature of the injury, its location on a vital body part (head), and the common intention to kill family members (which resulted in the death of an unborn child) fully justified life imprisonment under the second part of Section 307 IPC.
