This case concerns the validity of an order that was issued based on a High Court judgment. The Supreme Court had previously set aside the underlying High Court judgment in a related Civil Appeal. Consequently, the Court found that the impugned order could not stand. Rather than dispose of the matter finally, the Court set aside the impugned order and remitted it back to the lower court for reconsideration in light of the principles established when the foundational High Court judgment was overturned, to address other issues that would now arise from that reversal.
