This appeal concerns a partition of a Tarwad (a Hindu joint family structure common in Kerala) and the validity of a gift made by one branch (thavazhy) to another. The Trial Court found the partition valid and the gift lawful. The High Court reversed this. The Supreme Court disagreed with the High Court, holding that once a Tarwad is partitioned into distinct thavazhys, members of one branch cannot challenge gifts made by the other. The Court restored the Trial Court's order and allowed the appeal.
