Ali Mohammad Beigh and Ors vs State of J & K

Bench: 2 — R. Banumathi

In Brief

Land owners in Chandapora challenged compensation of Rs. 2,50,000/- per Kanal awarded for land acquired for resettlement of Dal dwellers. Adjacent villages (Bhagichandpora and Pazwalpora) received Rs. 4,00,000/- per Kanal for similar lands acquired simultaneously for the same purpose. The Supreme Court held that unequal compensation for comparable lands acquired at the same time and for the same public purpose is unjustified discrimination. The Court enhanced the appellants' compensation to Rs. 4,00,000/- per Kanal with 15% solatium, applying the principle of uniform valuation for similar properties acquired together.
