Ali Mohammad Beigh and Ors vs State of J & K

Bench: 2 — R. Banumathi

In Brief

Land owners in Chandapora village sought enhanced compensation for land acquired in 1997–1999 for resettlement of Dal dwellers. While they received Rs. 2.5 lakh per Kanal, adjacent villages (Bhagichandpora, Pazwalpora) acquired simultaneously received Rs. 4 lakh. The High Court dismissed their appeal for enhancement. The Supreme Court held that lands acquired at the same time, for the same purpose, in adjacent villages with common boundaries, and of similar nature must receive equal compensation. Discrimination without strong justification is impermissible. The Court enhanced compensation to Rs. 4 lakh per Kanal with 15% solatium, setting aside the High Court's orders.",
