All Escorts Employees Union sought to amend its constitution to include workers of Yamaha Motor India Private Limited (formerly Escorts Yamaha Ltd.), who ceased being union members after Yamaha separated from Escorts in 2001. The Registrar refused to approve the amendment. The Supreme Court dismissed the union's applications for recall of its September 2017 judgment. The Court held that the union cannot comply with statutory requirements (Trade Unions Act, 1926, Sections 6(e), 9A, 22) regarding membership of workers actually employed in the industry with which it is connected. Since Yamaha workers have formed their own separate, registered, and management-recognized union, the Escorts union cannot legally expand to represent them.
