All Escorts Employees Union sought to amend its constitution to include employees of Yamaha Motor India (formerly Escorts Yamaha Ltd.), a takeover company no longer part of Escorts Group. The High Court and Supreme Court dismissed both the writ petition and appeals. On review, the Court found that while the earlier judgment contained a factual error (the 2007 amendment's approval was later withdrawn), the legal conclusion remained sound. Statutory provisions require trade union membership to consist primarily of persons engaged in the industry with which the union is connected. Since all Yamaha workers had joined their own separate registered union, the appellant union could not maintain compliance with mandatory membership thresholds under the Trade Unions Act, 1926. Applications for recall were dismissed."
