In Brief
Amiruddin was convicted of murder under Section 302, IPC by the High Court. On appeal, the Supreme Court examined the evidence and found that the appellant inflicted only a single blow on the deceased, made no attempt to deliver further blows, and showed no intention to kill. The Court held that these circumstances indicated the offence was culpable homicide not amounting to murder under Section 304 Part II, IPC, not murder. The conviction was accordingly downgraded, and the sentence was reduced to the period already undergone, discharging bail bonds.
