Amit Rana @ Koka & Anr vs State of Haryana

Bench: 2 — C.T. Ravikumar, Rajesh Bindal

In Brief

Amit Rana and another were convicted of attempted murder under Section 307 of the Indian Penal Code and sentenced to 14 years rigorous imprisonment. The appellants challenged the sentence, arguing that Section 307 limits imprisonment to a maximum of 10 years unless life imprisonment is imposed. The Supreme Court held that Section 307 offers two sentencing options when hurt is caused: life imprisonment or punishment under the first part (maximum 10 years). Since the trial court declined to impose life imprisonment, the maximum permissible sentence was 10 years. The Court found the 14-year sentence impermissible and reduced it to 10 years. The fine was maintained.
