In Brief

A 55-year-old woman was allotted a residential plot under a Middle-Income Group housing scheme. After paying the initial down payment and three instalments, she defaulted on the remaining four instalments due to her husband's illness and financial hardship. Before receiving the cancellation notice, she paid the full outstanding amount with interest. The High Court dismissed her writ petition solely because she had not paid instalments on time. The Supreme Court set aside the cancellation, finding no willful default and accepting her offer of additional compensation, since she had demonstrated genuine bonafides by paying everything due with interest."
