The Bihar State Housing Board advertised a plot for a health centre but later offered alternative plots to the sole applicant (respondent) without a new advertisement. After the respondent accepted the allotment on multiple occasions and executed an agreement at an agreed price, it later challenged the price in court, claiming it was arbitrary. The High Court set aside the price. The Supreme Court allowed the Board's appeal, holding that once an allottee has accepted a price through payment and agreement execution, it is estopped from later disputing it. The Court also waived interest on delayed payment as the plot was for a hospital, conditioned on payment of the balance within six months.
