Supreme Court of India 2020-07-14 dismissed

Arjun Panditrao Khotkar vs Kailash Kushanrao Gorantyal and Ors

Bench: 3 — <UNKNOWN>, <UNKNOWN>, <UNKNOWN>

In Brief

This case concerns the admissibility of electronic records in election petition proceedings. The Supreme Court held that electronic records (computer output) printed on paper or stored in optical/magnetic media are admissible under Section 65B of the Indian Evidence Act without further proof of the original. The Court clarified that Section 65B certificates can be obtained by any person with access to the requisite authority, and electronic evidence must be furnished before trial begins to ensure fair trial. The Court upheld the High Court's finding that nomination papers were properly accepted despite the challenge that they were not presented by the Returning Officer, as electronic and other corroborating evidence supported this conclusion. The appeals were dismissed.">
