Arun Kumar and Ors. etc vs Union of India etc

Bench: 2 — Kurian

In Brief

The appellants challenged the compensation awarded for their lands acquired by the Union of India, arguing it was insufficient. The Supreme Court allowed their appeal and granted enhancement of compensation at 15% annually on a cumulative basis for the gap period of two years and six months. The Court found that similar cases had already established this principle of cumulative 15% annual increase. The judgment substituted the compensation calculation at Rs. 192 per square yard with the cumulative 15% enhancement applied, disposing of the appeal without order as to costs."
