Ashok Kumar & Ors vs Union of India & Anr

Bench: 2 — Amitava Roy

In Brief

This case involved sixteen consolidated Special Leave Petitions (converted into Civil Appeals) concerning compensation for land acquired in three villages: Masoodabad, Bamnoli, and Bijwasan/Pochanpur/Bharthal. The appellants challenged the land acquisition proceedings and compensation amounts determined by lower authorities. The Supreme Court found that the relevant facts, statutory notifications, and compensation issues in these appeals were identical or analogous to three earlier batch decisions of the same Court. Accordingly, the Court condoned the delay in filing and awarded compensation at the rates previously fixed in those precedential cases, along with all statutory benefits and interest under the Land Acquisition Act, 1894. The appeals were disposed of on this basis.
