Ashwini Kumar Upadhyay vs Union of India and Ors

Bench: 3 — <UNKNOWN>, <UNKNOWN>, <UNKNOWN>

In Brief

The petitioner sought directions to frame a National Policy promoting the National Anthem, National Song, and National Flag under Article 51A of the Constitution. The Supreme Court clarified that Article 51A mandates respect only for the National Flag and National Anthem, not any National Song. Accordingly, the prayer relating to a National Song was rejected. However, the prayer relating to schools was kept alive based on earlier submissions by the Attorney General in a related petition. The matter was tagged with the earlier writ petition (No. 855 of 2016) for consolidated consideration.
