Ashwini Kumar Upadhyay vs Union of India and Ors

Bench: 3 — <UNKNOWN>, <UNKNOWN>, <UNKNOWN>

In Brief

The petitioner sought a National Policy to promote the National Anthem, National Song, and National Flag under Article 51A of the Constitution, and requested feasibility studies on singing these nationally in Parliament, Assemblies, Courts, and Schools. The Supreme Court clarified that Article 51A(a) imposes duties to respect the National Flag and Anthem but does not mention the National Song. The Court dismissed most prayers but kept alive only the prayer concerning schools, referring the matter to a related earlier petition (WP 855/2016) already pending before it.
