The Supreme Court dismissed an appeal challenging the Administrative Tribunal's direction to fill Assistant Engineer posts in Tamil Nadu in a 3:1 ratio (75% by direct recruitment, 25% by transfer). The appellant contended that Overseers and Civil Draftsmen should not be eligible for transfer recruitment and that persons appointed through direct recruitment were illegally occupying transfer quotas. The Court held that the 1985 Special Rules govern recruitment and permit Overseers and Civil Draftsmen to be promoted by transfer if they meet qualification requirements. Persons appointed through direct recruitment after acquiring requisite qualifications while serving do not usurp transfer quotas and must be counted towards the direct recruitment quota. The Court affirmed the Tribunal's order and upheld the 3:1 recruitment ratio.
