The Association of Engineers challenged rules allowing Overseers and Civil Draftsmen to be promoted to Assistant Engineer positions, arguing they should not be eligible and that the 3:1 direct recruitment-to-transfer ratio was being violated. The Supreme Court upheld the Tamil Nadu Engineering Service Special Rules of 1985, which clearly permit such promotions when candidates possess required qualifications (AMIE or B.E. Degree) and service. The Court held that Overseers and Civil Draftsmen qualified for transfer recruitment, and those meeting eligibility criteria could also claim direct recruitment positions without violating reserved quotas. The appeal was dismissed.
