Ayurved Vikas Mandal vs State of Gujarat & Ors

Bench: 2 — Kurian

In Brief

A grant-in-aid Ayurveda college was converted to self-financing status with Government permission, but 23 teachers' salaries were subsequently discontinued. The State declined to fully absorb them as the High Court had directed, citing precedent concerns. The Supreme Court disposed of the appeal by accepting the State's revised proposal to accommodate 16 employees in vacancies at other Ayurveda colleges and settle remaining 7 retirees' pension claims. The Trust was directed to pay all arrears within three months and allowed to mortgage or sell property if needed to meet these salary obligations, with the judgment noted as applicable only to these peculiar facts."
