B.N. Srivastava, accused in a corruption case, was granted bail by the trial court but with an onerous condition to deposit Rs. 50 lakh within four weeks. The High Court stayed this condition pending an interim deposit of Rs. 10 lakh, which the appellant made. The Supreme Court held that while the trial court was justified in granting bail, the Rs. 50 lakh deposit condition was excessive and unreasonable. Since the appellant had already deposited Rs. 10 lakh and co-accused received bail without deposit conditions, the Court modified the order, requiring only the amount already deposited while maintaining other bail conditions.
