Balwan Singh & Ors vs Land Acquisition Collector & Anr

Bench: 2 — Kurian

In Brief

Balwan Singh and others appealed for interest on land compensation after being dispossessed by the Government. The Supreme Court held that while the Land Acquisition Act does not provide statutory interest, landowners are entitled to damages for use and occupation during the period the Government retained possession. The Court awarded additional interest at 15% per annum from the date of dispossession to the date of Notification under Section 4(1), calculated on the land value fixed by the Reference Court, and directed deposit within three months.
