Raj Kumar and Ors vs State of Punjab and Ors

Bench: 2 — Kurian

In Brief

The appellants challenged the acquisition of their land by the state for a grain market. Despite awards being passed in 2013, some claimants had not received compensation, and multiple rounds of litigation had ensued over more than a decade. The Supreme Court allowed the appeal and directed the Reference Court to dispose of pending enhancement cases within three months. Claimants not yet before that court were permitted to apply for compensation redetermination under Section 28A. The Collector was ordered to disburse awarded amounts with interest within two months. The Court declined to entertain further challenges to the validity of the acquisition itself.
