The Authority appealed, but the Division Bench dismissed the appeal without substantively addressing the factual and legal issues. The Supreme Court held that Division Benches must engage with and decide all material issues raised in intra-court appeals, not dispose of them cursorily. The Court set aside the Division Bench's order and remanded for fresh consideration on merits.
