Bangalore Development Authority vs B.N. Ramalingaswamy & Ors

Bench: 2 — Abhay Manohar Sapre

In Brief

The Bangalore Development Authority acquired agricultural land in Bangalore through a 1976 notification. The landowners challenged the acquisition in a writ petition, which the Single Judge allowed. The Authority appealed, but the Division Bench dismissed the appeal without substantively addressing the factual and legal issues. The Supreme Court held that Division Benches must engage with and decide all material issues raised in intra-court appeals, not dispose of them cursorily. The Court set aside the Division Bench's order and remanded for fresh consideration on merits.
