Bangalore Development Authority vs B.N. Ramalingaswamy & Ors

Bench: 2 — Abhay Manohar Sapre

In Brief

The Bangalore Development Authority appealed a High Court decision dismissing its challenge to an adverse writ petition ruling on land acquisition. The Single Judge had annulled the Authority's acquisition of land in Jedahalli Village. The Division Bench affirmed this without addressing the substantive legal and factual issues. The Supreme Court held that an appellate bench must engage with all issues raised in an appeal and provide reasoned findings. Finding the Division Bench had disposed the matter too summarily, the Court set aside its judgment and remanded the case for fresh consideration on merits within six months.
