Raghubir Singh vs State of Rajasthan & Ors

Bench: 2 — Abhay Manohar Sapre

In Brief

This appeal challenges the High Court's dismissal of an intra-court appeal against a Single Judge's order that had rejected a writ petition challenging Section 4 notifications under the Land Acquisition Act. The Supreme Court found that the Division Bench failed to address any of the factual or legal issues raised by the appellant or deal with the submissions pressed in the appeal. The Court held that a Division Bench must address all issues in an intra-court appeal and record findings on each. The judgment was set aside and the case remanded to the Division Bench for fresh decision on merits within 6 months.
