Bank of India sought to challenge orders from the National Consumer Dispute Redressal Commission (NCDRC) and State Commission (SCDRC) awarding a customer compensation for alleged delay in sanctioning a credit facility. The customer had revised his credit requirements three times, causing delay, then obtained credit elsewhere and sued the bank under the Consumer Protection Act. The Supreme Court held that although the bank had offered to refund Rs. 9.16 lakhs in processing charges via email, the customer did not accept this proposal. Therefore, the customer was entitled only to the bank's offered refund, not to a full waiver of all TEV charges. The Court also clarified that any concession on multiple charges must be calculated cumulatively. The appeal was allowed and the orders of SCDRC and NCDRC were set aside.
