Banti and Ors vs State of Rajasthan

Bench: 3 — <UNKNOWN>, <UNKNOWN>, <UNKNOWN>

In Brief

The appellants were convicted of rioting, causing hurt and criminal intimidation under the Indian Penal Code, 1860. The case involved a dispute from 2006 between the appellants and the complainant. Both parties subsequently reached a compromise and sought permission from the Court to compound the offence under Section 320 of the Criminal Procedure Code, 1973. The Supreme Court allowed the appeal, holding that the offence of criminal intimidation was not substantiated by evidence regarding common object or weapon type. The Court granted permission to compound the remaining offences, set aside the High Court's conviction, and allowed the appeals, giving effect to the settlement between the parties."
