Beena R vs Kerala Public Service Commission & Ors

Bench: 2 — Kurian

In Brief

Beena R applied for the post of Lower Division Typist with the Kerala Public Service Commission. Although she held a National Trade Certificate (equivalent to KGTE Typewriting) rather than KGTE itself, she had separately acquired a Computer Word Processing certificate after the notification's cutoff date. The Commission initially rejected her, then included her at Rank 7, but later objected to her certificate's timing. The Supreme Court allowed her appeal, holding that the word 'produce' in the notification qualification requirements means submission at examination time, not prior acquisition. Since she had produced the certificate before examination and was already ranked, her appointment should proceed within three months.
