Bengal Chemicals and Pharmaceuticals Limited owned a public property leased to Ajit Nain for 21 years from 1993, expiring on 31 May 2014. After expiry, renewal negotiations failed because the landlord proposed unilaterally increased rent from Rs.21 to Rs.50 per sq. ft., which the tenant rejected. The tenant remained in occupation without paying rent, leading to an eviction order by the Estate Officer. The Supreme Court affirmed the High Court's decision to remit the matter for fresh consideration, finding the tenant entitled to sufficient hearing opportunity. However, pending fresh consideration, the tenant was ordered to pay interim damages for use and occupation at Rs.2,50,000 per month (June 2014–May 2018) and Rs.3,00,000 monthly thereafter."
