In Brief
A widow and children of a 52-year-old man killed in a motor accident sought enhanced compensation for their loss. The High Court had reduced the multiplier from the standard formula and awarded inadequate consortium compensation. The Supreme Court found the High Court erred in not following established multiplier principles. It granted interim relief: fixing the multiplier at 11; awarding the widow Rs.1,00,000 for loss of consortium; granting the children collectively Rs.1,00,000 for loss of love and care. On the disputed issue of enhancement for future prospects (where conflicting precedents existed), the Court withheld decision pending a larger Bench reference.
