A senior medical officer, Dr. Bhupinderpal Singh Gill, was served with disciplinary charges eleven days before retirement on grounds of non-compliance with Election Commission directions, unauthorised leave, and non-participation in a pulse polio programme. The Supreme Court set aside all disciplinary orders and restored his full pension without any deduction. The Court found the charges unsupported by legal evidence, as the appellant was never assigned such duties. The Court further held that the disciplinary action was mala fide retaliation for the appellant's earlier successful litigation against government officials. The Court awarded Rs. 50,000 costs and directed return of deducted pension amounts with 6% interest.
