Biju K. K vs Cochin University of Science and Technology, Kochi & Ors

Bench: 2 — M.R. Shah

In Brief

Biju K.K. was employed as a daily wager Technical Assistant and later applied for the same position through a selection process. He was ranked low on the merit list because the Selection Committee gave him fewer marks for experience, disregarding his prior service as a daily wager. The High Court dismissed his challenge, stating the Selection Committee's decision could not be interfered with. The Supreme Court partly allowed his appeal, holding that courts must review Selection Committee decisions on merit and cannot merely defer to them. The matter was remitted for fresh examination of whether the experience marks were justly denied and whether another selected candidate met eligibility requirements.
