Binod Kumar @ Binod Kumar Bhagat vs State of Bihar

Bench: 2 — <UNKNOWN>, <UNKNOWN>

In Brief

Binod Kumar was arrested in August 2016 on charges involving possession of Corex cough syrup containing codeine at a transport company godown in Bihar. The High Court denied bail. The Supreme Court granted bail after noting that the Delhi High Court had subsequently quashed the government's prohibition notification on the same drug as invalid, and the appellant had been in custody since arrest. The Court directed release on Rs. 25,000 personal bond with two sureties of equal amount, allowing the trial judge to impose attendance conditions.
