Binod Kumar @ Binod Kumar Bhagat vs State of Bihar

Bench: 2 — <UNKNOWN>, <UNKNOWN>

In Brief

Binod Kumar, manager of a transport godown, was arrested on charges of unlawfully possessing Corex cough syrup containing codeine—4,000 bottles recovered during a search in August 2016. He was denied bail by the High Court. The Supreme Court noted that the Delhi High Court had quashed the Government's notification prohibiting this drug on 1 December 2016—after the FIR but before this appeal. Given the drug's subsequently validated legal status, the appellant's extended custody, and his role as a subordinate employee, the Court allowed the appeal and granted bail of Rs. 25,000 with two sureties.
