Three men were convicted of murder for their role in a fatal assault on Raju Bose in 1995. While they admitted holding the victim during the scuffle, the evidence showed that only one accused (Tarit Kundu) inflicted the fatal stab wound to the chest using a sharp weapon. The Supreme Court found that merely holding the victim without clear evidence of intent to aid the fatal blow does not establish common intention to commit murder. The Court granted the appellants the benefit of doubt and acquitted them of the murder charge, setting aside their life sentences."
