In Brief
Employees of the Supreme Court Legal Aid Committee and Supreme Court Legal Services Committee sought recognition of their entire service—including periods before 2000—as qualifying service for pension calculation. The Union of India argued benefits could only be counted from the Rules' promulgation date (03.07.2000). The Supreme Court held that regular employees rendering continuous service must have their entire tenure counted for retiral benefits, without distinction based on regulatory dates. The Court also rejected a procedural objection, finding that claims not expressly decided in an earlier petition remain maintainable. The petition was allowed, directing full pension benefit credit for all service periods.
