Supreme Court of India 2016-03-10 remanded

C.B.I vs R.R. Kishore

Bench: 2 — <UNKNOWN>, <UNKNOWN>

In Brief

The Central Bureau of Investigation challenged a Delhi High Court judgment that had granted the respondent, an accused senior government officer, protection under Section 6A(1) of the Delhi Special Police Establishment Act, which required prior Central Government approval before investigating corruption allegations against certain high-level officers. While a Constitution Bench had previously struck down this provision as unconstitutional, the question remained whether that judgment operated retrospectively to strip immunity from those charged before the judgment. The Supreme Court referred this fundamental issue concerning the retrospective effect of constitutional judgments and the scope of Article 20 protections to a larger bench."
