In Brief
The Supreme Court set aside a High Court order discharging accused persons in a murder case. The case involved a murder victim found dead in his bedroom with no eyewitness (blind murder). During investigation, psychological evaluations, polygraph tests, and BEOS profiling were conducted on the accused and associates, indicating their involvement. The High Court discharged the accused based on selective reference to some witness statements while ignoring other evidence. The Court held that at the discharge stage, the entire material produced by prosecution must be considered; a prima facie case need only be made out, not proof beyond doubt. The Court cannot conduct a selective review amounting to a "mini trial." The Court allowed the appeal and remitted the case for trial.
