Catherine Anderson, an Australian citizen, filed an application under Section 11 of the Arbitration & Conciliation Act, 1996 in an international commercial arbitration dispute with Ashwani Bhatia. The partnership deed-based arbitration agreement did not specify a seat or place of arbitration. The Court held that it has power to direct a seat of arbitration in such circumstances and appointed Shimla as the seat of arbitration. The petition was disposed of accordingly with all pending applications also being disposed.
