In Brief
In these interlocutory appeals in a public interest litigation matter, the Supreme Court modified its earlier order regarding service of summons upon four foreign accused persons (two individuals and two companies from Malaysia). The Court clarified that while the method of service initially suggested might not be appropriate, alternative proper methods could be adopted to compel their appearance. Significantly, the Court held that non-responsive accused persons are barred from claiming monetary losses resulting from the enforcement orders issued by the Court.
