A widow claimed compensation under the Workmen's Compensation Act after her husband, an employee of a road transport corporation, died of a heart attack while on duty. The Commissioner awarded Rs. 3,79,120 with interest accruing only if payment was delayed. Both the High Court and employer appealed. The Supreme Court upheld the award as all factual findings were properly decided by the Commissioner. However, it modified the interest provision: interest at 12% per annum must run from the accident date (not from a later default date), as liability arises when injury occurs. The appeal was partly allowed with directions for recalculation of the total amount payable.
